Terms Of Service
This agreement (the “Agreement”) is entered into by and between you (”you”) and PointAbout (the “Company”, and the “Service(s)” regarding your use of all aspects of PointAbout services. By using the PointAbout Service, you consent to be bound by these terms and conditions. For clarity, these terms and conditions apply only to participants in the PointAbout Service. Unless otherwise explicitly specified, all PointAbout Services are governed by the PointAbout Terms of Service.
1.0 The Service
PointAbout has developed a series of springboards which allow HTML code to be embedded inside native applications, along with http://www.AppMakr.com (the “Website”) and the AppMakr service as a computer online service that provides online application-related services to users who develop and publish applications. The Service is accessible to you through a personal computer, or other access device, via the Website using a communications connection (e.g., modem and telephone line and/or cellular network) using the software made available to you through PointAbout and the guidelines provided on the Website (the “Software Guidelines”). PointAbout reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that PointAbout shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
2.0 Modifications to this Agreement
POINTABOUT RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO MODIFY THIS AGREEMENT AT ANY TIME BY POSTING A NOTICE ON THE WEBSITE, OR BY SENDING YOU A NOTICE VIA EMAIL. You shall be responsible for reviewing and becoming familiar with any such modifications, which shall be effective when posted on the Website or when notice is sent to you. Your use of the Service after posting or notice constitutes your acceptance of the terms and conditions of this Agreement as modified. This Agreement, together with the PointAbout Privacy Policy and DMCA Policy and any other legal notices published by PointAbout on the Website shall constitute the entire Agreement between you and PointAbout concerning the Service.
3.0 Eligibility
By using the Service, you represent and warrant that:
1. (a) either you are at least 18 years of age or older and you have legal capacity to agree to this terms and conditions; you are between the ages of 13 and 17 and you have legal capacity to agree to these terms and conditions because your parent or legal guardian has authorized you to do so; or you are an individual entering this agreement on behalf of an entity, and you are authorized to bind the entity to this agreement;
2. (b) all registration information you submit is accurate and truthful;
3. (c) you will maintain the accuracy of such information;
4. (d) your use of the Service does not violate any applicable law or regulation.
Your account, profile, and all associated Content (as defined below) may be deleted and your membership may be terminated without warning if PointAbout believes that you are in breach of any of the foregoing representations and warranties. POINTABOUT RESERVES THE RIGHT TO REFUSE PARTICIPATION TO ANY APPLICANT OR USER AT ANY TIME IN ITS SOLE DISCRETION.
4.0 Service Access
4.1 Subject to your compliance on a continuing basis with all of the terms and conditions of this Agreement, PointAbout hereby grants you permission to use the Service only as set forth in this Agreement, and provided that:
1. (a) You will be responsible for obtaining or providing all connectivity and computer equipment or other access devices necessary to access the Service;
2. (b) you will otherwise comply with this Agreement, including the Privacy Policy and DMCA Policy;
3. (c) you will not copy or distribute any part of the Website or Service in any medium without PointAbout’s express authorization;
4. (d) you will not alter or modify any part of the Website or Services other than as expressly authorized;
5. (e) you will not circumvent, disable, violate or attempt to violate, or otherwise interfere with the security or integrity of the Website or Service, the proper operation of the Website or Service, or interfere with any activity being conducted on the Website or Service;
6. (f) you will not post content or items in an inappropriate category or areas on the Site;
7. (g) you understand that PointAbout may, in its sole discretion, cancel any offer or remove any Content (as defined below) posted through the Service if it believes there is evidence supporting violation of these terms;
8. (h) you will not distribute or post pornography, spam, chain letters, pyramid schemes, viruses or any other technologies that may harm PointAbout, or the interests or property of PointAbout’s users;
9. (i) you will not harvest or otherwise collect information about Content, or users, including email addresses, without their consent;
10. (j) you will be responsible for withholding, filing, and reporting all taxes (except POINTABOUT’s U.S. income taxes), duties and other governmental assessments associated with your use of the Service;
11. (k) you agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc., that accesses the Service in a manner that sends more request messages to the PointAbout servers in a given period of time than a single human can reasonably produce in the same period by using a conventional on-line web browser;
12. (l) you agree not to collect or harvest any personally identifiable information, including account names, from the Service, nor to use the communication systems provided by the Service for any commercial solicitation purposes;
13. (m) you agree that your Content both will not contain restricted or password only access pages or hidden pages or images; and
14. (n) you will not violate any laws, third party rights, or our policies;
PointAbout reserves the right in its sole discretion to block access or discontinue services to offenders, and to investigate and take appropriate legal action against anyone who, in PointAbout’s sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities.
4.2 Links and Frames. The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Your use of other sites or resources are governed by terms on or related to such sites or resources. Use of such sites or resources is at your own risk. Because PointAbout has no control over such sites and resources, you acknowledge and agree that PointAbout is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that PointAbout shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
4.3 Links and Frames. The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Your use of other sites or resources are governed by terms on or related to such sites or resources. Use of such sites or resources is at your own risk. Because PointAbout has no control over such sites and resources, you acknowledge and agree that PointAbout is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that PointAbout shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
5.0 Intellectual Property Rights
5.1 Content. The content on the Website and available through the Service, including without limitation, the games, text, software, scripts, graphics, files, images, photos, sounds, music, videos, advertisements, interactive features and the like (collectively “Content”) and the trademarks, service marks and logos contained therein (”Marks”), are owned by or licensed to PointAbout, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. PointAbout reserves all rights not expressly granted in and to the Service and the Content. You agree to not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any other purposes whatsoever any Content, including, but not limited to, image, audio, and visual content, Marks, third party User Content, or other proprietary rights not owned by you, (i) without the express prior written consent of the respective owners, and (ii) in any way that violates any right of any third party. If you download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein. You agree not to publish content that violates an Application Store’s (ex. Apple iTunes AppStore) Terms of Service.
5.2 PointAbout Service. The PointAbout Service is owned by or licensed to PointAbout. PointAbout grants you a limited, revocable, non-exclusive license to use, copy, and incorporate the PointAbout Service in your application(s) (”Application(s)”) solely in conjunction with the Service consistent with this Agreement and the Software Guidelines. You may not modify, resell, redistribute, decompile, hex-dump, decouple, reverse engineer or otherwise manipulate the PointAbout Service without prior written consent from PointAbout. Except as expressly provided for in this Section, you are not granted any other rights, title or interest in the PointAbout Service. You shall not copy the PointAbout Service except as set forth herein. Any copy of the PointAbout Service that you make must contain the same copyright and other proprietary notices that appear on or in the PointAbout Service Software or Content.
5.3 User Submissions
1. (a) The Service permits the submission of Apps and Ads (as defined below) containing images, recordings, videos or other communications submitted by you and other users (”User Submissions”) and the hosting, sharing, and/or publishing of such User Submissions. You understand that PointAbout does not guarantee any confidentiality with respect to any such submissions.
2. (b) You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. You agree that PointAbout has no liability with respect to any User Submissions, including, without limitation, your own submissions, and you hereby irrevocably release PointAbout and its officers and directors, employees, agents, representatives and affiliates, from any and all liability arising out of or relating to User Submissions or any part thereof.
3. (c) In connection with your User Submissions, you affirm, represent, and warrant that you can and will demonstrate to PointAbout’s full satisfaction upon its request that:(i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize PointAbout to use each and every image and sound contained in each such User Submission and to enable inclusion and use of such User Submissions in the manner contemplated by the Service and this Agreement;(ii) specifically, you have the written consent, release, and/or permission of each and every identifiable individual person in the User Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Submissions in the manner contemplated by the Service; and (iii) the posting of your User Submission on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity. You agree to pay all royalties, fees, and other monies owing any person or entity by reason of any content posted by you to or through the Service.
4. (d) By submitting User Submissions to PointAbout, or displaying, publishing, or otherwise posting any content on or through the Service, you hereby do and shall grant PointAbout an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, fully paid, sub-licensable and transferable license to use, modify, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Submissions in connection with the Service and PointAbout’s (and its successors and assigns) business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby do and shall grant each user of the Service a non-exclusive license to access your User Submissions through the Service, and to use, modify, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the Service and under this Agreement. For clarity, the foregoing license grant to PointAbout does not affect your other ownership or license rights in your User Submission(s), including the right to grant additional licenses to the material in your User Submission(s).
5. (e) In connection with User Submissions, you further agree that you will not:(i) publish falsehoods or misrepresentations that could damage PointAbout or any third party;(ii) submit material that is unlawful, obscene, lewd, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, excessively violent, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate or objectionable;(iii) impersonate another person;(iv) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity right, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant PointAbout all of the license rights granted herein;or (v) submit material that is unsuitable for minors in any country. PointAbout does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and PointAbout expressly disclaims any and all responsibility or liability in connection with User Submissions.
6. (f) PointAbout reserves the right to decide whether Content or a User Submission is inappropriate or violates this Agreement, including but not limited to copyright infringement, violations of intellectual property law, pornography, obscene or defamatory material, or excessive length. PointAbout also reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages and User Submissions) by you, or to restrict, suspend or terminate your access to all or any part of the Service at any time, for any or no reason, with or without prior notice. Notwithstanding the foregoing, PointAbout assumes no responsibility for monitoring the Service, Content, or User Submissions for inappropriate conduct, or modifying or removing such conduct, Content or User Submissions from the Service.
7. (g) In particular, if you are a copyright owner or an agent thereof and believe that any User Submission or other content infringes upon your copyrights, you may submit a notification pursuant to our DMCA Policy.
6.0 Term
6.1 This Agreement shall remain in full force and effect while you use the Service. You may terminate your use of the Service at any time by following the instructions on the Website. You agree that PointAbout, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any User Submissions within the Service, for any reason or no reason, including, without limitation, for lack of use or if PointAbout believes that you have violated or acted inconsistently with the letter or spirit of this Agreement. PointAbout may also in its sole discretion, for any reason or no reason and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Agreement may be effected without prior notice, and acknowledge and agree that PointAbout may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that PointAbout Media shall not be liable to you or any third-party for any termination of your access to the Service.
7.0 Disclaimer of Warranty
TO THE FULLEST EXTENT PERMITTED BY LAW, POINTABOUT, ITS SUPPLIERS, AFFILIATES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, NEITHER POINTABOUT NOR ITS SUPPLIERS, NOR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS, MAKES ANY WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE, CONTENT, OR THE CONTENT OF ANY SITES LINKED TO THE SERVICE, AND NONE ASSUMES ANY LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF THE SERVICE, ADS, OR CONTENT;(II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICE;(III) ANY UNAUTHORIZED ACCESS TO OR USE OF THE SERVICE AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN;(IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE;(V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY;AND/ OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICE OR ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE. POINTABOUT DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICE OR ANY HYPERLINKED SERVICE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND POINTABOUT WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. THE SERVICE IS CONTROLLED AND OFFERED BY POINTABOUT FROM ITS FACILITIES IN THE UNITED STATES OF AMERICA. POINTABOUT MAKES NO REPRESENTATIONS THAT THE SERVICE IS APPROPRIATE OR AVAILABLE FOR USE IN OTHER LOCATIONS. THOSE WHO ACCESS OR USE THE SERVICE FROM OTHER JURISDICTIONS DO SO AT THEIR OWN VOLITION AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAW.
8.0 Limitation of Liability
YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE, CONTENT AND POINTABOUT SOFTWARE IS AT YOUR OWN RISK. IN NO EVENT SHALL POINTABOUT, ITS SUPPLIERS, AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING LOST PROFITS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES WERE FORESEEABLE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT COMPANY SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS SOLELY AND ENTIRELY WITH YOU. THESE LIMITATIONS SHALL APPLY EVEN IN THE EVENT OF A FUNDAMENTAL OR MATERIAL BREACH OR A BREACH OF THE FUNDAMENTAL OR MATERIAL TERMS OF THIS AGREEMENT. YOU SPECIFICALLY ACKNOWLEDGE THAT POINTABOUT SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS SOLELY AND ENTIRELY WITH YOU. IN NO EVENT WILL EITHER PARTY’S LIABILITY FOR MONETARY DAMAGES UNDER THIS AGREEMENT EXCEED THE AMOUNT PAID UNDER THIS AGREEMENT BY POINTABOUT TO YOU. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.
9.0 Indemnity
You agree to defend, indemnify and hold harmless PointAbout, and its distribution partners, subsidiaries, affiliates, and their directors, officers, agents, members, shareholders, co-branders or other partners, employees, and Ad Partners from any liabilities, losses, actions, damages, claims, obligations, costs, expenses or demands (including, but not limited to attorneys’ fees, costs and expenses) arising out of (a) content you provide to PointAbout or otherwise transmit or obtain through the Service, (b) your use of the Service, (c) your connection to the Service, (d) your violation of any term of this Agreement or your representations and warranties set forth above, (e) your violation of any rights of another, including without limitation any copyright, property, or privacy right, (f) your failure to perform your obligations hereunder, or (g) any claim that one of your User Submissions caused damage to a third party.
10.0 Third Party Beneficiaries
You agree that any Ad Partner that supplies any Ad or any distribution partner that distributes your Applications(s) shall be third party beneficiary with respect to this Agreement, and that any such Ad Partner or distribution partner shall have the right to enforce such provisions in its own name as if the Ad Partner or distribution partner were PointAbout. You further agree that you shall not raise lack of privity as a defense against any Ad Partner or distribution partner seeking to enforce the provisions of this Agreement.
11.0 Publicity
You agree that PointAbout may use your name, logo, and the title(s) and logo(s) of your Application(s) in presentations, marketing materials, customer lists, financial reports and Web site listings of customers.
12.0 User contact
This shall be determined based on your service level agreement in the Service.
13. Application Stores (example: Apple AppStore)
Your application may need to be reviewed by an application store before being released to the public. PointAbout cannot guarantee that your application will be approved by an Application Store (such as the Apple AppStore). If your application is not approved for release to the public for any reason, you agree to hold PointAbout harmless. Any fees paid to PointAbout are non-refundable for any reason.
14. Branding
This shall be determined based on your service level agreement in the Service.
15. Analytics
This shall be determined based on your service level agreement in the Service.
16. Ad Network
This shall be determined based on your service level agreement in the Service.
17. Revenue Sharing
This shall be determined based on your service level agreement in the Service.
18. Application Signing
You agree to provide PointAbout the ability to perform provisioning of applications (leveraging Keys, Certificates, Provisional Files and similar) on your behalf and that you will provide all data necessary to sign applications for the different vendors environments. You agree to hold PointAbout harmless should any of the information you provide for these purposes become public or otherwise cause you harm. DO NOT PROVIDE POINTABOUT WITH ANY CONFIDENTIAL INFORMATION YOU ARE NOT WILLING TO PUT AT RISK.
19. Miscellaneous
This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. In the event of a conflict between the terms of this Agreement and any other terms set forth in the Website or Service (including without limitation, the terms of the FAQ sections of the Website) the terms of this Agreement shall supersede and control. This Agreement shall be construed in accordance with the laws of the District of Columbia, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. Each provision of this Agreement is intended to be severable. If any term or provision hereof shall be determined by a court of competent jurisdiction to be illegal or invalid for any reason whatsoever, such provision shall be severed from this Agreement and shall not affect the validity and enforceability of the remainder of this Agreement. You may not assign, voluntarily, by operation of law, or otherwise, any rights or delegate any duties under this Agreement without PointAbout’s prior written consent, and any attempt to do so without that consent will be void. PointAbout may assign this Agreement to a successor in interest in connection with a change of control, a sale of substantially all of its assets, or a merger, acquisition, public offering or other reorganization transaction. The section headings used herein are for convenience only and shall not be given any legal import. The parties shall attempt to resolve any controversy or claim arising out of or relating to the creation, performance, termination and/or breach of this Agreement in the first instance through good faith negotiation or mediation between the parties. Any claims or disputes arising from or related to this Agreement shall be resolved through binding arbitration under the Federal Arbitration Act, 9 U.S.C. � I et. seq. via the American Arbitration Association located in San Francisco, California, U.S.A. and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Notwithstanding the foregoing, and solely with respect to breaches or threatened breaches of this Agreement, either party to this Agreement may seek a temporary restraining order and injunction to protect its legal rights or interests, without the need to post bond in any court having jurisdiction.

Native Application vs. Web Application:
A native application is a piece of software. Think of it just like software on your computer, like Microsoft Office, for example. You download native applications onto your phone, just like you would install Microsoft Office onto your computer. Most of the icons on an iPhone are native applications.
Web applications, by contrast, are served to you inside a website. There’s nothing to install. The problem is, web applications don’t have access to all the phone’s features like native applications do. That’s where PointAbout comes in. We bridge both worlds and give you the best of each.

Think of a “microsite” as a “child” to your main PC-based website. If your main website is www.YourBrand.com, then your web-based microsite might be www.YourBrand.mobi, or http://m.YourBrand.com. The beauty of using the web to create your microsite is that you have access to all the same data that your main PC-based site does.
Additionally, since your microsite is just a website, your existing programmers will know exactly what to do to make it based on your requirements. We even have a robust development section to help them build the microsite out. You get to use all your existing databases, image assets, and even much of your existing code to make a “child” microsite to your main PC website. This is native code that PointAbout develops for each different phone platform, such as the iPhone, BlackBerry, Android, Windows Mobile, etc. Think of it as the “frame” of a picture. Your microsite is the “picture” inside the frame. All you have to worry about is picture, and we can change the “frame” depending on what phone platform wants to use the application.
The “frame” we create is very important because it allows you to get access to the phone’s features, such as the phone’s camera, accelerometer, address contact book, GPS or Cell-ID information, and more. With this information, you can do much, much more than you could do with a regular website.

PointAbout announced today a partnership with Qorvis Communications and Patton Boggs, LLP, along with support by Zagat Surveys, LLC to create an Inauguration Application for the 2009 Barak Obama Washington DC Inauguration.
The application has been approved by Apple in the iTunes App Store and is currently available for download.

PointAbout, Qorvis, Patton Boggs and FortiusOne devised, executed and delivered a 2009 Inauguration Guide iPhone and BlackBerry application in an astounding 3 weeks from start to finish – a timeframe that would have been unthinkable with a fully native application.
Here are details on how we did it:
What
§ Qorvis and Patton Boggs created a free mobile Inauguration Guide application for multiple mobile devices.
§ The first iteration will work on iPhones, with a Blackberry version to follow later. We are also pursuing development of a version for Android (Google’s phone) in early 2009.
§ The application will provide GPS-enabled information about where inaugural galas and events are being held. It will deliver the basics in real time about where to eat, walking directions to the inauguration, what metro line to take and how to find a museum.

- Local weather, traffic, and news

- Bars and nightclubs, powered by Zagat

Why

How
· Qorvis and Patton Boggs have a lot of clients and friends coming to Washington, DC for the Presidential Inauguration. Given the historic proportions of this year’s event, we knew it would be important to help our guests navigate the city—something we help them do professionally anyhow. Instead of just giving everyone maps and restaurant recommendations, we felt it was most appropriate to create a mobile application, which would also serve to celebrate the nation’s first high-tech president.
· As a fully integrated communications firm, Qorvis had the in-house capabilities to design the web application, but it would take too long and cost too much to make a fully native iPhone application. Our friends at PointAbout solved this problem by “wrapping” our web application with their thin-client springboard to mobilize the app on the mobile platforms as a hybrid web and native application—iPhone, BlackBerry, Android, etc. We got the best of both worlds with this approach; the speed & flexibility of a web application, coupled with the benefits of a native application, such as use of the camera, GPS, etc. PointAbout also added on a polling component to gauge real-time user sentiment about the Inauguration. FortiusOne came aboard to help analyze and visualize the results through their GeoCommons platform.
What will happen to the application after the Inauguration?
· The app will become a general guide to Washington, DC. Since PointAbout is wrapping our web-based application with their native client, we have the flexibility to change it as often as we want – a benefit that would not otherwise be available to us had we created a fully-native application. Thereofore, we will be able to improve the functionality of this application as we approach the inauguration, and after the inauguration we can change it to focus on “Navigating Washington” without the inauguration component, as the tools will still be very useful.

I’ve just finished creating a 12 page marketing brochure for potential PointAbout clients. I call it “on demand marketing” where I’m creating the PDF collateral as clients are requesting specific information. That’s how this specific document was created — based on client requests for information. Since we’re still a small company, I’m handling both marketing and sales, so I’m getting to flex my Photoshop and InDesign skills in addition to being on the telephone all day. As we grow we’ll bring in a dedicated marketing person. Like any entrepreneur knows, the entrepreneur’s life is like a lake: A mile wide and a foot deep in various skillsets. Gotta know how to do a little bit of everything!
